01 · Introduction

A family foundation is a Polish institution introduced in 2023 that holds the family’s assets and pays benefits to its members according to rules set by the founder. It allows a business and assets to pass to future generations without being split up with each inheritance.

We prepare the charter, the list of assets, the contribution of shares or real estate and the registration. We design the benefits plan and its tax consequences together with a tax adviser.

02 · Scope

What the service includes

  • Charter, beneficiaries, foundation bodies
  • List of assets and contribution of shares or real estate
  • Entry in the register of family foundations
  • Benefits plan with a tax adviser

03 · What it means

What it means for you

For you this means clear rules for the future of your assets and business: who receives benefits and when, who manages and how decisions are made. Heirs do not need to split shares or sell the business to settle accounts.

A foundation may conduct limited business activity, including managing shares, real estate and securities.

Who it is for: Business owners and families who want to organise their wealth for generations.

04 · Why it matters

Why it matters

01

Succession

Without a plan, shares in the business pass to many heirs, which often paralyses decisions and leads to the sale of the business.

02

Taxes

The foundation’s income is in principle exempt from CIT; tax is paid when benefits are paid to beneficiaries.

03

Protection

Assets in the foundation are separate from the private assets of family members.
