Buying and renting offices, warehouses and apartments in Poland, with no surprises in the land and mortgage register.

2%PCC on secondary market purchases
notarial deedrequired for a sale
MSWiApermit for some foreign nationals

01 · Introduction

Buying an office, warehouse or apartment in Poland starts with the land and mortgage register and ends at the notary. In between there are several points where it is easy to lose money: mortgages, easements, the local zoning plan, pre-emption rights and permits for foreign nationals.

We check the property before anything is signed, draft the agreements and coordinate the notary, the bank and the seller.

02 · Scope

What the service includes

  • Review of the land and mortgage register, encumbrances and zoning plan
  • Preliminary and final agreement, coordination with the notary
  • MSWiA permit for buyers from outside the EEA
  • Commercial leases: offices and warehouses
  • Transaction costs: PCC or VAT, notary fee

03 · What it means

What it means for you

For you this means certainty that you are buying exactly what you are paying for, with no hidden encumbrances. Before the preliminary agreement you receive a report on the land and mortgage register, the zoning plan and the risks.

If you are buying as a foreign national from outside the European Economic Area and Switzerland, we check whether an MSWiA permit is required and prepare the application.

Who it is for: Companies looking for an office or warehouse and private investors buying an apartment in Poland.

04 · Why it matters

Why it matters

01

Security

The land and mortgage register and the zoning plan show whether the property is free of mortgages, easements or a planned road.

02

Koszty

PCC of 2% or VAT, the notary fee and court fees amount to a few percent of the price. We calculate them before you decide.

03

Legality

A purchase without the required MSWiA permit is invalid. It is one of the most expensive mistakes foreign buyers make.
