Litigation and debt collection in Poland

PrawoHLBC

Payment demand, e-court, mediation and arbitration. How to recover money from a Polish counterparty.

Introduction

Most commercial disputes start with a demand for payment. When that is not enough, the creditor can use electronic writ-of-payment proceedings (e-court), ordinary proceedings, mediation or arbitration.

How it works

  • the e-court issues payment orders in monetary cases, entirely online
  • claims related to business activity are usually time-barred after 3 years
  • mediation is cheaper and faster if the parties are willing to talk
  • foreign judgments from the EU are recognised in Poland under a simplified procedure

Why it matters and what is important

The cheapest dispute is the one prevented by a good contract and counterparty verification before signing. In a dispute time matters, because the debtor’s assets may disappear.
